Scope

This No Return, No Exchange & Cancellation Policy (“Policy”) governs all orders placed with NIRVANA CLOTHING STORE(“Company”, “we”, “our”, or “us”) through our website or any other sales channel operated by us.

By placing an order with the Company, the customer (“Customer”, “you”, or “your”) confirms that they have read, understood, and accepted this Policy and agree to be bound by its terms.

Nature of Products

All products offered by the Company are manufactured strictly on a made-to-order and/or customised basis according to the specifications, artwork, logo, design, colour, size, text, embroidery, print, measurements, or any other customisation instructions provided or approved by the Customer.

Each product is individually handcrafted and produced specifically for the Customer. Accordingly, such products are unique in nature and are not capable of being resold to another customer in the ordinary course of business.

In view of the personalised nature of the products supplied by the Company, all sales are final.The Company shall not accept any request for return, exchange or refund of products that have been manufactured or customised in accordance with the Customer’s specifications, except as expressly provided under Clause 7 of this Policy or where otherwise required under applicable law.

Reasons NOT accepted — without limitation:

Change of mind
Incorrect size selected by the Customer
Incorrect colour selected by the Customer
Customer dissatisfaction with a design approved by the Customer
Errors in names, initials, artwork, logos or text supplied by the Customer
Minor variations inherent in handcrafted manufacturing
Delay attributable to incorrect or incomplete information provided by the Customer
Any other reason not arising from an error attributable to the Company

Customer's Responsibility

The Customer shall be solely responsible for reviewing and verifying all order details prior to confirming the purchase, including but not limited to:

Product specifications
Quantity
Size and measurements
Colour selection
Artwork, logo, graphics and text
Delivery address
Contact details
Any customisation instructions

Once production has commenced, no modification, cancellation or correction shall ordinarily be permitted.

The Company shall not be responsible for any loss arising from incorrect information submitted by the Customer.

Handmade & Manufacturing Variations

The Customer acknowledges and agrees that all products are handcrafted and individually manufactured.

Expected Variations — NOT Defects

Colour tone
Print placement
Embroidery placement
Stitching
Fabric texture
Dimensions
Finishing
Overall appearance

Minor and commercially acceptable variations in the above aspects shall not constitute a manufacturing defect, deficiency in service or non-conformity, and shall not entitle the Customer to seek any return, exchange or refund.

Product Images

Images displayed on the website are for representational purposes only.

Actual colours and appearance may vary due to photography, lighting conditions, fabric dye lots, display settings, monitor calibration and other technical limitations.

Such differences shall not be construed as defects or grounds for return, exchange or refund.

Defective, Damaged or Incorrect Products

Nothing contained in this Policy shall restrict or limit the Customer’s statutory rights available under applicable law.

Eligible claim conditions

The product has a manufacturing defect
The product is materially different from the order confirmed by the Company
The product has been damaged during transit
The product suffers from any deficiency directly attributable to the Company

Defective Product Claim Process

Step 01

Notify within 48 hours

Contact the Company within 48 hours of delivery.

Step 02

Provide documentation

Submit: order number · clear product photographs · photographs of the shipping package (where applicable) · a detailed description of the issue.

Step 03

Company verification

The Company reserves the right to inspect, investigate and verify every claim before determining its validity.

Step 04

Possible resolution

Upon verification, the Company may, at its sole discretion and subject to applicable law: repair the product · replace the product · provide store credit · or process such other remedy as may be considered appropriate.

Cancellation of Orders

Orders cannot be cancelled once production, customisation, printing, embroidery or fabrication has commenced.

Since all products are manufactured exclusively upon receipt of confirmed orders, cancellation requests shall not be accepted after this point.

Requests received prior to commencement of production may be considered solely at the discretion of the Company.

Right to Reject Claims

The Company reserves the right to reject any claim where:

The product has been used, worn, washed, altered or damaged after delivery
The alleged defect arises from incorrect specifications supplied by the Customer
The claim relates to normal manufacturing variations
Adequate documentary evidence has not been provided
The claim is made beyond the reporting period specified in this Policy

Limitation of Liability

To the extent permitted under applicable law, the Company’s liability in respect of any valid claim shall be limited to the repair, replacement or refund of the affected product, where the Company determines that the defect or deficiency is attributable solely to the Company.

Exclusion of consequential damages

The Company shall not be liable for any indirect, incidental, consequential, exemplary or special damages, including but not limited to loss of profits, business interruption or loss of opportunity arising out of or in connection with any order placed by the Customer.

Nothing contained herein shall exclude or limit any liability that cannot be excluded under applicable Indian law.

Governing Law & Jurisdiction

This Policy shall be governed by and construed in accordance with the laws of India.

Jurisdiction

Subject to applicable law, any dispute arising out of or relating to this Policy shall be subject to the exclusive jurisdiction of the competent courts at Hyderabad, Telangana, India.

Statutory / Consumer Rights

Nothing contained in this Policy shall be interpreted as limiting, excluding or waiving any rights available to consumers under:

Consumer Protection Act, 2019
Consumer Protection (E-Commerce) Rules, 2020
Any other applicable law for the time being in force

The Company reserves all rights and remedies available under applicable law.
